Leo hoy un teletipo de la Agencia Europa Press:
"El equipo de seguridad del primer ministro turco, Recep Tayyip Erdogan, ha protagonizado varios momentos de tensión esta mañana a la entrada y en el interior del Palacio Municipal de Congresos de Madrid, done se celebra el primer foro de la Alianza de Civilizaciones, informaron a Europa Press fuentes policiales."El tema de la seguridad entre los periodistas graficos es un tema delicado. Debido a la naturaleza de nuestro trabajo, estar cerca de las personalidades es absolutamente necesario, por lo que siempre somos conisderados un riesgo para los VIPs. Si a eso le añadimos la enorme cantidad de aparatos electrónicos que llevamos -que hay que pasar por los rayos-x, echate a temblar.
Con los turcos la cosa debe haber estado jodida, ayer, que estaba yo solo, ya tuve problemas -véase la foto de abajo-. El tipo este no acertaba a entender que yo tenia que hacer una foto -era el fotógrafo oficial del acto- y lo curioso es que no me echaba de allí, sino que se ponía en medio para que no hiciera la foto. Es decir, si no me echaba significaba que yo no era un riesgo para la seguridad, entonces... ¿para que se ponía en medio? Misterios.Problemas, lo que se dice problemas, no tenemos muchos y la mayoría son culpa de las malas organizaciones de los actos, que obligan a salir al VIP por un pasillo de medio metro mientras cincuenta lameculos le hacen la pelota, diez asesores le acompañan, ocho fotografos y camaras lo medioviolan y un par de escoltas hacen lo que pueden.
Así, recuerdo cuando vino Chavez a España; uno de sus guardias personales me levanto en vilo -y no son 50 kilos- y me desplazo unos dos metros como si tal cosa, también he tenido movida con algunos polis flipaos -sobre todo munipas- y, por supuesto, con los vigilantes privados.
En España los círculos seguridad mas ferreos están entorno al rey y a ZP. En el primer caso no suele haber problemas porque si no estás en lista no pasas -punto- y si pasas te hacen tal chequeo que lo mas que puedes hacerle al cheriff es decirle tonto, y en bajito. En el caso de ZP la Guardia Civil que le rodea cuando la prensa esta cerca es absolutamente profesional; hacen su trabajo sin impedirte hacer el tuyo. No ponen mala cara y si te tienen que dar un toque te lo dan cuando nadie ve y de buen rollo.
El resto de grupos de seguridad tiene su aquel... algunos van de estrella, otros no se preocupan mas que de lo suyo -que no digo que no, pero hombre, tampoco tanto- y otros están ahí como si pones un palo de escoba. Hay de todo.

Inauguro el debate. Las imágenes de Atlas no reflejan apenas el incidente. Desde dentro ha tenido bastante más chicha. De hecho, desde Reuters hemos clavado una exclusiva de la reyerta en Eurovisión (aplausos, risas...). Todo ha empezado cuando al fotógrafo oficial de Erdogan ha querido entrar como suelen hacer los periodistas gráficos de los países que nos visitan: por la puerta principal y con recibimiento de estado. Cuando nuestros simpáticos compatriotas de seguridad han hecho muralla para impedirle el paso, el fotógrafo se ha puesto bravo y se ha llevado un par de manducos. Los turcos han contraatacado y dentro de la puerta giratoria ha habido de todo. Insisto en que en las imágenes de Reuters se ve más y mejor (aplausos, risas...). ¿Quién la ha liado? Un fotógrafo (aplausos, risas...)
Post scriptum: ¿Hacemos un glosario de razones estúpidas por las que un informador gráfico no puede tomar determinada imagen o permanecer en determinado lugar?
Entonces de quien ha sido la culpa ¿? del fotografo que se ha pasao de listo o de la seguirdad española que ha pecado de exceso de celo ¿?

Bromeaba sobre lo del que la ha liado. Cuando he mirado ya estaba montada la gresca y veía al fotógrafo intentar entrar a toda costa y a los trajeados de pinganillo echando el resto para que no entrase. Ahí ha sido cuando sus homólogos turcos se han lanzado a repartir, mientras esa Canon sobresalía sufriendo espasmos por encima de las cabezas. ¿La culpa? ¿Cuántas veces utilizamos la fuerza para entrar a un sitio? ¿Cuántas veces la emplean para sacarnos? Entre todos la mataron...

Es cierto que el fotógrafo oficial intenta entrar delante de su jefe; coño esa es precisamente su obligación pasar delante de su jefe; no querrás que le saque fotos del culo, la culpa no es del fotógrafo que no conoce el ferial, el se baja de un coche y sigue a los de protocolo, son esas personas que tu conoces “pelotas”, “asesores”, “correveidiles” y demás figurantes, los que no se preocupan de introducir al fotógrafo en el acto sin romper los protocolos y los cordones de seguridad y son esos “payasos” que solo se enteran a medias de las ordenes los que suelen joder las cosas.
A mi me sacaron casi a ostias del auditorio donde estaba ZP cuando dijeron que todos fuera, simplemente por estar mas cercano a un energúmeno que el resto y resulta que yo tenia tarjeta de POOL, afortunadamente tenia cerca de mi a “Marianete” que me salvo de la movida ¿pero que seria de esta profesión sin estas pequeñas movidas?
Siempre que coinciden diferentes grupos de seguridad, suceden estas cosas de la descoordinación.

Lo cierto es que no suelo dejar comentarios pero quiero contar una cosa que me paso el otro dia, hubo una detención en publico en la Gran Via madrileña, y claro, quien aspira a fotoperiodista, reportero grafico o fotografo de calle pues no puede dejar pasar una cosa asi, asique claro, hice mis fotos sin estorbar, sin molestar a nadie y tal... el caso que se me acerca un gorila con pintas de policia (o era al reves, bueno el caso que era muy grande) y con un tono muy agresivo me pidio mi documentacion y ME OBLIGO A BORRAR TODAS LAS FOTOGRAFIAS, es decir, A DESTRUIR MI PROPIA OBRA, si ocurre en la calle los fotografos podemos fotografiar cualquier cosa asi que yo sepa no inflingia ley alguna, de todos modos yo solo hacia mi trabajo, dudo que un policia tenga derecho (y menos de malas maneras con frases como "tu trabajas con gente normal... yo con ecuatorianos, colombianos..." "borra todas las fotos en las que salga yo" (por cierto no salia en ninguna y en ninguna se reconocia ningun policia puesto que o estaban de espaldas o encuadraba quitandoles la cara), y lo mejor fue la despedidida cuando le pedia ciertas exlipcaciones "no voy ha hablar contigo"
bueno, lo cierto es que es algo que me amargo el dia... nadie tiene derecho a un escultor o a un pintor a obligarle casi por la fuerza a destruir su obra, los fotografos de veriamos de gozar del mismo derecho, ¿que hay de la proteccion de patrimonio artistico? esas fotografias podian haber acabado facilmente en una galeria o en un book y no...
En fin, imagino que historias como estas hay miles, creo que hay asociaciones de fotografia y periodismo donde deveriamos revidndicar nuestro derecho a trabajar... y el derecho a que nuestra obra no se desprecie

El unico que legalmente puede obligarte a borrar unas fotografias es un juez. punto. La policia puede detenerte y llevarte delante del juez pero nada mas.

Amigo, Navas. Nunca debiste borrarlas. Un día estaba grabando en la Plaza de Santa Ana unas imágenes de gente sentada en las terrazas, cuando unos policías salieron persiguiendo a un tío hasta que lo redujeron. Muy espectacular y yo muy contento de haberlo grabado. Me viene un madero a decirme que deje de grabar, que esto no le importa a nadie. Le digo que a mí sí. (Grababa de lejos y sin estorbar). Documentación y leches. Le doy la cartera y el DNI y sigo grabando y me dice que deje de grabar. Le digo que no voy a parar y que si me toca lo denuncio. Se pone delante. Lo esquivo. Me dice que le enseñe la cinta. (Ya no queda nada por grabar). Saco la cinta y se la enseño. Me dice que si me creo muy gracioso. Le contesto ue en general, sí. Me dice que si me cachondeo de él. Le digo que no, y que si no hay ningún problema, que me devuelva el DNI, que quiero irme.
Si el tío tiene ganas de montarla, aquello hubiese acabado muy mal. Pero bajo ningún concepto, dejes que te hagan borrar o entregar una imagen. Es más, no tienen derecho a no dejarte captarla en la mayoría de los casos, y todos sabemos cuáles son aquellos en los que hayque cortarse. (No serán más de dos o tres, ¿no, compis?)
Hay que hacer algo, ya. No sé el qué, compañeros, pero hay que moverse. Parecemos la prima tonta de la fiesta. Todo al que le apetece tocarle las pelotas a alguien, nos las toca a nosotros y no pasa nada.
El tema de las fotos de agentes de la ley es peliagudo, como el de las fotos de menores, pero con riesgo para la vida. Los medios parecen no ponerse de acuerdo en si se debe mostrar o no el rostro reconocible. No tardará en llegar el tiempo en que sólo veamos por las calles policías enmascarados al estilo de las ficciones distópicas como 1984.
Mira cualquier detención en Euskadi, cómo van los ertzainas, Defcontroll. Parece que han entendido que hay otra gente que tiene que hacer su trabajo. No pretendems joderle la vida a nadie, pero el problema de la privacidad es suyo. Me parece una putada, pero son ellos los que tienen que tomar medidas, no el fotoshop o la censura.
Buscando, buscando me he encontrado con este blog; y me ha resultado curiosa la entrada... ahora mismo yo soy estudiante de derecho y también me gusta bastante la fotografía, de tal manera que, en el momento que cuando me dijeron "no puedes hacer tal foto" o "si un policía te dice que tienes que borrar una foto la tienes que borrar" me extrañé e investigué el trasfondo legal...
Bien, ahora os mostraré los argumentos legales que tenéis a favor y en contra, porque las leyes, están para leerlas... nunca os creáis lo que os diga Fulanito o Menganito de tal o cual ley... indagad, que están redactadas en un lenguaje muy sencillito.
Primero y principal, cuando un policía os asalte porque estéis fotografiando, grabando, dibujando, etc… algo tened en cuenta el artículo 14.4 del Real Decreto Legislativo 1/1996, de 12 de abril; que dice lo siguiente:
Artículo 14 Contenido y características del derecho moral
Corresponden al autor los siguientes derechos irrenunciables e inalienables:
[…]
4 Exigir el respeto a la integridad de la obra e impedir cualquier deformación, modificación, alteración o atentado contra ella que suponga perjuicio a sus legítimos intereses o menoscabo a su reputación.
[…]
Por tanto, hagáis lo que hagáis, no permitáis que, una vez realizada la obra NADIE os puede decir que la borréis, ya que sería un atentado contra vuestra creación.
Eso sí, hay que tener en cuenta que a tenor del artículo 8 de la LO 1/1982, de 5 de mayo:
Artículo 8
1. No se reputarán, con carácter general, intromisiones ilegítimas las actuaciones autorizadas o acordadas por la Autoridad competente de acuerdo con la ley, ni cuando predomine un interés histórico, científico o cultural relevante.
2. En particular, el derecho a la propia imagen no impedirá:
a) Su captación, reproducción o publicación por cualquier medio cuando se trate de personas que ejerzan un cargo público o una profesión de notoriedad o proyección pública y la imagen se capte durante un acto público o en lugares abiertos al público.
b) La utilización de la caricatura de dichas personas, de acuerdo con el uso social.
c) La información gráfica sobre un suceso o acaecimiento público cuando la imagen de una persona determinada aparezca como meramente accesoria. Las excepciones contempladas en los párrafos a) y b) no serán de aplicación respecto de las autoridades o personas que desempeñen funciones que por su naturaleza necesiten el anonimato de la persona que las ejerza.
Es decir, que podéis hacerle fotos a personajes públicos en actos públicos y lugares abiertos al público. Lo que sí esta prohibido es hacerle fotos a cualquier persona en actos privados, es decir, realizando actividad de estricta privacidad, no puedes hacerle fotos a tus vecinos cuando están en su casa, por ejemplo.
Tampoco está penado que alguien aparezca reflejado en un suceso o acontecimiento público y cuando una persona determinada aparezca como meramente accesoria, es decir, que en el caso de Kacho, por ejemplo, hiciste bien al imponerte y al decirle que no ibas a borrar tu obra ya que la detención era de carácter público, eso sí, podría haberte llevado a comisaría y haberte puesto a manos de dirección fiscal, como es un acto bastante leve y la profesión de policía exige por su naturaleza una cierta discreción, sí podría haberte hecho borrar, no la cinta entera, pero sí ese trozo, un juez… pero nunca un policía.
Lo que sí incurre en ilícito, supongo que de carácter civil y no penal, es la fotografía o el vídeo a alguien específico sin su consentimiento. Los famosos “robados”. Retratos a personas anónimas que no mantienen ningún tipo de vínculo con nosotros y que desconocen estar siendo fotografiadas.
Por cierto, lo de ponerse delante de la cámara también es lícito, pero también es lícito esquivarle ;).
